Clarification Text Regarding the Protection and Processing of Personal Data

The purpose of the Law on the Protection of Personal Data No. 6698 (“KVKK”), which entered into force on April 7, 2016, is to ensure the privacy of private life and the protection of fundamental rights and freedoms during the processing of personal data. As Project Mergen (“Company / Data Controller”), we declare that the personal data belonging to natural persons—such as candidate engineers, applicants, and newsletter subscribers—who contact our company will continue to be processed in accordance with the KVKK, with maximum care given to privacy and security.

  • Statistics, analysis, reporting, and the development of company processes,

  • Meeting company needs within the scope of legitimate interests.

5. Legal Grounds for Processing Personal Data

Your processed personal data is handled in accordance with the personal data processing conditions listed in Article 5 of the KVKK, based on the following legal grounds:

  • Being necessary for the establishment or performance of a contract,

  • Legitimate interest of the data controller,

  • Obtaining your explicit consent (e.g., for newsletters, marketing, communication, etc.),

  • Being expressly provided for in the laws.

6. To Whom and For What Purposes Personal Data May Be Transferred / Shared

In necessary cases, personal data transfers may be made within the framework of the KVKK and relevant legislation, in a limited manner suitable for the purpose, to:

  • External suppliers from whom the Company receives services, technical infrastructure providers, and information-communication service firms,

  • Authorized public institutions and organizations pursuant to legal obligations.

7. Rights of the Data Subject

Pursuant to Article 11 of the KVKK, as the data subject (concerned person), you have the following rights:

  • To learn whether your personal data is being processed,

  • To request information if it has been processed,

  • To learn the purpose of the processing and whether it is used in accordance with these purposes,

  • To know the third parties to whom it is transferred domestically or abroad,

  • To request correction if it is processed incompletely or incorrectly,

  • To request the deletion or destruction of the data,

  • To request notification of these operations to third parties to whom it has been transferred,

  • To object to the result if an analysis is made exclusively by automated systems,

  • To exercise other rights provided in the legislation.
